the insufficiency of law

Post by Advocate »

There is no foundation of morality in law. In every country, but i'm speaking in particular of the US, even to the extent there is a claimed element of morality underpinning future legal decisions, they are routinely ignored. Due process is ignored. Constitutional rights are ignored. Innocent until proven guilty is ignored. Plea bargains are inherently unjust. Incarceration systems do not rehabilitate. People are not treated as individuals. The law changes constantly. Sentencing guidelines are arbitrary. Nobody understands it. Minor inconveniences can be felonies and life-destructive acts can be explicitly legal.

Laws are guidelines for the ignorant and enshrining momentary understandings is always subject to refutation. We need to have common-sense leaders we can trust to do their best, regardless of what bureaucratic decisions came before them. If we can't trust our leaders, the law is impotent, especially if they're chosen by the same system of law. If the leaders are good, the law is unnecessary except as a guideline.
