How about viewing child pornography, gambling or taking drugs?

Making child porn falls pretty clearly into the category of 'hurting' while making adult porn does not. As for viewing child porn: it's the product of an illegal act...prosecute for 'possession of' and nuthin' more.
Gambling: can't see why it should be illegal. If fools wanna give their cash away, it's not my business.
Drugs: if Louis sits in front of his tv gettin' whacked on [insert drug name] I can't see how that's my business. If Louis gets behind the wheel of his car whacked on [insert drug name], well that another matter completely. The question is: do you prosecute Louis for being whacked while driving, or do you prosecute him for 'improper use of a movable'?
