ignorance of the law isn't an excuse when it's a reason

Post by Advocate »

It is entirely possible to drive a stretch of highway without ever seeing a speed limit sign, even if you're looking for one.

If ignorance of the law is not considered a valid reason for breaking it, you cannot rely on innocence to protect you from punishment and you cannot rely on the state to protect you if you are innocent. This inherently creates instability and distrust.

Legal fiction are still fictions and as they do not represent reality, are an abdication of responsibility and justice. "Status crimes", age of consent laws, speed limits, and so forth all fit this description. "Drive safely" is a valid law.

In the modern context, law is so mind-bogglingly maybe and complex literally no one understands it. There's an army of judges and lawyers having it out every day and an army of politicians and bureaucrats creating and manipulating it constantly.
