Primary and Secondary Law in a Global Society
It is evident that law must be considered at two levels, if not three.
The primary level that enables society to exist.
Secondary law that defines the principal forms of society.
The most heinous crimes in primary law must presumably be such as genocide and destruction of the infrastructure and environment necessary to life.
Law at the secondary level protects the principal forms of society. Which is not to say that altruism, anarchism, and tyranny can exist on friendly terms. Anarchism can only survive if personal autonomy is preserved at some substantial level. Tyranny or mere authoritarianism, and servility, is essentially class based. Altruism is of communities in mutual benefit.
there is a third level for law which strays into danger. Effectively elevating cultural fashion to moral law, as may be the stuff of tyranny. For the altruist culture is anything that is innocuous. Where it goes beyond that it may be necessary to tolerate it as a matter of pragmatism, without approval.
