Primary and Secondary Law in a Global Society
It is evident that law must be considered at two levels, if not three.
The primary level that enables society to exist.
Secondary law that defines the primary forms of society.
The most heinous crimes in primary law must presumably be such as genocide and destruction of the infrastructure and environment necessary to life.
At the secondary level law protects the principal forms of society. Which is not to say that altruism, anarchism, and tyranny can exist on friendly terms. Anarchism can only survive if a globalised personal autonomy is preserved at some level. Tyranny or mere authoritarianism is essentially class based. Altruism is of concentric communities in mutual benefit.
A tertiary level of law strays into considerable danger. Effectively elevating cultural fashion to moral law. It may often be the stuff of tyranny. For anarchism it remains as fashion for the individual and family. For the altruist community and global society, culture must be innocuous or otherwise proscribed. If it is necessary to temporarily tolerate it as a matter of pragmatism.
There are no doubt some people who barely believe in any form of society, who might temporarily stride the world as warriors or as Moriarty master criminals, with no craving for wealth or power only personal honour.
